WEEE and RoHS

As a distributor, Avnet Technology Solutions relies on our manufacturers to ensure compliance with the regulations for Waste Electric and Electronic Equipment (WEEE) and the Restriction on Hazardous Substances (RoHS). In both cases the manufacturer holds the obligation to comply. Depending on the specific situation in the countries, Avnet Technology Solutions may provide this service at a European level. Avnet Technology Solutions will use best efforts to be compliant and fulfill its mandatory obligations.

Please note that all obligations under the respective legislation refer to the end-product only and are always subject to the date when products are placed on the market. In respect of the RoHS directive, products we supply to you may have been put on the market before the products are actually shipped to you. Therefore you might receive products with a label that shows a later date. These are nevertheless compliant.

Please understand that as a distributor we are unable to confirm what substances are in the electric and electronic equipment we are distributing. The manufacturer can declare and give any binding confirmation in respect of the compliance to the RoHS- Directive. This also applies to the precise dates as to which point in time their products will be RoHS compliant.

The WEEE directive
The purpose of the WEEE directive (2002/96/EC) is the reduction of waste electrical and electronic equipment, and to promote the reuse, recycling and other forms of recovery of such wastes as to reduce the disposal of waste. The directive shall be applicable from the 13th August 2005 and also applies to old EEE which were put on market during the last 8 years. It is the Producers responsibility for complioance with the WEEE directive in each member state. The "producer" could be the manufacturer or the organisation who resells the products under his own brand or who imports or exports EEE on a professional basis to an EU member state. In respect of the WEEE directive the responsibility that applies to Avnet Technology Solutions will depend on the respective contractual obligations with each supplier, details of which (for WEEE) can be obtained upon request..

The obligations of the "producers" for the concerned products are:

Registration as "producer" in each local EU country with waste-authorities
Marking products with brand or company name crossed out wheelie binand that put on the market after 13th August 2005
Reporting on sales to the local market
Financing the recovery of the products
Information to end-users.
Affected by the directives are products which:

Dependent on electric currents or electro-magnetic fields in order work properly
Equipment for the generation, transfer and measurement of such currents or fields
Falling under the categories set out in Annex IA of the directive
Designed for use with a voltage rating not exceeding 1000 Volt for alternating current and 1500 Volt for direct current
Finished products with direct function, own enclosure and ports and connections intended for end users (if applicable).
Categories of electrical and electronic equipment covered in Annex IA:

Large household appliances
Small household appliances
IT and telecommunications equipment
Consumer equipment
Lighting equipment
Electrical and electronic tools (with the exception of large-scale stationery industrial tools)
Toys, leisure and sports equipment
Medical devices (with the exception of all implanted and infected products)
Monitoring and control instruments
Automatic dispensers

The RoHS directive
The purpose of the RoHS directive (2002/95/EC) is the restriction of the use of hazardous substances in EEE and to contribute to the environmentally sound recovery and disposal of WEEE. The "producers" have to ensure that after the 1st July 2006 the amount of the materials listed below is restricted in EEE and corresponding spare parts.

Hexavalent Chromium (Cr6)
Polybrominated Biphenyls (PBB)
Polybrominated Diphenyl Ethers (PBDE)
Exceptions are for medical and military devices and spare parts for repair or reuse of EEE put on market before 1st July 2006.

SOFTWARE LICENSE AGREEMENT
This is a legal Agreement between you and Avnet Technology Solutions ltd. By installing this software you are agreeing to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, promptly return the disk package and the accompanying items, including the accompanying manual, to Avnet Technology Solutions ltd. Failure to adhere to the license terms will result in legal action by Avnet Technology Solutions ltd. to recover damages.

LICENSE TERMS

The software and information supplied are proprietary and confidential. You are required to protect the software and information from disclosure to others with the same degree of care accorded to your own information.
Avnet Technology Solutions ltd. reserve the right to change prices without notice.
You may install this software only on systems which will be used EXCLUSIVELY by your own employees.
You may not reverse engineer, decompile, disassemble, or create derivative works from this software or information.
The software and related documentation are provided AS IS. No other warranty is expressed or implied.
In no event shall Avnet Technology Solutions ltd. be liable for any damages whatsoever (including without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use of or inability to use this product.

No deviation from the license terms above is permitted except with the express prior written authorisation from Avnet Technology Solutions.
